These Employer Terms of Use (these “Terms”) apply to employers, NGOS, and organizations (an “Employer” or “you or “your”) seeking to post jobs/adverts and hire candidates through the CROSSNGOJOBS website and associated platforms (collectively, “CROSSNGOJOBS”). These Terms contain the conditions that govern your access to and use of the CROSSNGOJOBS – please review and agree to them as an Employer before moving forward.
Note: If you are a Candidate using CROSSNGOJOBS to apply for job opportunities, please read the Candidate Terms of Use.
1. Acceptance of Terms
By accessing and using CROSSNGOJOBS, you agree to be bound by these Terms and all applicable laws. If you do not agree with any portion of these Terms, you may not use CROSSNGOJOBS.
Your use of CROSSNGOJOBS may be subject to additional terms and conditions specific to certain features or services offered therein. In such cases, your use of those features or services constitutes your acceptance of the additional terms and conditions.
If you are using CROSSNGOJOBS as a company representative, you represent and warrant that you have the legal authority from the entity to do so and bind the entity to these Terms.
2. Who We Are
CROSSNGOJOBS is provided by CROSS SECTOR HIRES LIMITED. We operate CROSSNGOJOBS from our base of operation in Nigeria. If you have any questions, enquiries, concerns, complaints, feedback, ideas, suggestions, or reviews about these Terms or any part of CROSSNGOJOBS, please contact us using the Contact Us section of the website or by mailing us at admin@crosssectorhires.com.
3. Usage Eligibility
Employers’ representatives must be at least 18 years of age to use CROSSNGOJOBS. By accessing or using CROSSNGOJOBS, you represent and warrant that you meet the age requirement.
- You must have the legal capacity to enter into these Terms and to abide by its terms and conditions.
- You agree to comply with all applicable laws and regulations governing your use of CROSSNGOJOBS, including but not limited to laws related to privacy, data protection, intellectual property, and online conduct. You are solely responsible for ensuring that your use of CROSSNGOJOBS is lawful and does not violate the rights of any third party or infringe upon any intellectual property rights.
- You are not eligible to use CROSSNGOJOBS if you have previously been suspended or banned from using it or if you have previously violated these Terms. You may not use CROSSNGOJOBS if you are located in a location where access to or use is prohibited by law.
- You must be a legal entity with the right licenses to hire Candidates. We reserve the right to perform background checks on your entity to determine whether you meet this requirement.
- We reserve the right to suspend or terminate your access to CROSSNGOJOBS if we believe that you do not meet the eligibility requirements set forth in these Terms.
4. Registration and Account Creation
Account Creation: To submit adverts and posts or use other company features on CROSSNGOJOBS, you must create an account and submit accurate and complete personal data, including the name of representative, company name, CAC certificate, website, and similar information. You agree to update such information to keep it accurate, current, and complete.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. You agree to keep your login credentials confidential and to notify us immediately of any unauthorized use of your account or any other breach of security.
- Third-Party Accounts: In addition to the traditional account registration, you may have the option to create your Employer account using third-party services such as Facebook, X (formerly Twitter), Google, or LinkedIn (“Third-Party Accounts“). By using Third-Party Accounts to register for an account on CROSSNGOJOBS, you authorize us to access and use certain information from your Third-Party Account, as permitted by the terms and conditions of the provider. You agree that you are solely responsible for managing your Third-Party Accounts and for any consequences of linking or unlinking such accounts with your CROSSNGOJOBS account.
- Prohibited Uses: Your account is for your company’s use only and may not be shared with or transferred to any other person or entity (except to an authorized individual within your company). You may not use another user’s account without their permission, nor may you impersonate another person or entity. You agree not to create multiple accounts for the purpose of abusing or circumventing CROSSNGOJOBS’ policies or restrictions.
- Account Termination: You may terminate your account at any time by using the “Delete Profile” button under your account dashboard. We also reserve the right to suspend or terminate your account and/or access to CROSSNGOJOBS at our discretion, with or without cause, and without prior notice. Upon termination of your account, your access to CROSSNGOJOBS may be discontinued, and any data associated with your account may be deleted in accordance with our Privacy Policy.
5. Privacy Policy
The collection and use of any personal data you submit on CROSSNGOJOBS, including, without limitation, your name, email address, company information, and any content submitted on the website, is used in accordance with our Privacy Policy. Please read and consent to it along with these Terms, as it describes the data we collect and how we use it. By submitting personal data on CROSSNGOJOBS, you agree to our Privacy Policy.
6. Job Postings
By posting jobs and adverts on CROSSNGOJOBS, Employers agree to the following:
- All job postings must be accurate, truthful, and compliant with all applicable laws and regulations, including anti-discrimination laws.
- Job descriptions should clearly outline the duties, qualifications, and benefits associated with the position.
- You agree to communicate with all Candidates in a professional and respectful manner throughout the hiring process.
- Job postings and all communication with candidates must not contain any discriminatory or offensive language, misleading information, or false promises.
We reserve the right to remove any job posting that violates these Terms or is deemed inappropriate.
7. Fees and Payments
CROSS SECTOR HIRES LIMITED may charge fees for posting jobs and adverts on CROSSNGOJOBS. The associated fees will be presented to you and are due before service is provided.
- You agree to pay all fees associated with your use of CROSSNGOJOBS in accordance with the chosen payment method on the payment page. By providing your payment method information, you authorize us to deduct the applicable fees from your selected payment method.
- Except where provided, fees do not include any taxes or payment method charges.
8. User Content
Responsibility for Content: In addition to the content associated with your job postings, you may have the opportunity to post testimonials, comments, reviews, or other user-generated content on the website (“User Content“). You are solely responsible for the User Content you post on the website, and you represent and warrant that you have all necessary rights, permissions, and licenses to publish such content. You agree not to post any User Content that is unlawful, defamatory, libelous, obscene, indecent, harassing, threatening, abusive, fraudulent, or otherwise objectionable.
- License Grant: By posting User Content on the website, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, perform, and display such User Content in any media or format. You also grant other users of CROSSNGOJOBS the right to access and use your User Content in accordance with these Terms.
- Ownership of Content: You retain ownership of the intellectual property rights in your User Content, subject to the license grant described above. You acknowledge and agree that we may use your User Content for promotional or marketing purposes, including but not limited to featuring your testimonials or comments on our website or in other marketing materials.
- Content Moderation: We reserve the right, but not the obligation, to monitor, screen, edit, or remove User Content at any time and for any reason without prior notice.
9. Intellectual Property and License
Ownership of Content: All content and materials available on the CROSSNGOJOBS website and related platforms, including but not limited to text, graphics, logos, images, audio clips, video clips, and software, are owned by or licensed to CROSS SECTOR HIRES LIMITED and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You acknowledge and agree that CROSS SECTOR HIRES LIMITED and its licensors retain all rights, title, and interest in and to the content and materials available on CROSSNGOJOBS, including any modifications, enhancements, or derivative works thereof.
- Limited License: Subject to your compliance with these Terms, CROSS SECTOR HIRES LIMITED grants you a limited, non-exclusive, revocable, non-transferable license to access and use the content and materials available on CROSSNGOJOBS solely for your personal, non-commercial purposes. You may not reproduce, distribute, transmit, display, perform, or create derivative works based on the content and materials available on CROSSNGOJOBS without the prior written consent of CROSS SECTOR HIRES LIMITED or the respective rights holder.
- Trademarks: The trademarks, service marks, logos, and trade names displayed on CROSSNGOJOBS are owned by or licensed to CROSS SECTOR HIRES LIMITED and may not be used without our prior written consent or the respective rights holder. You agree not to remove, alter, or obscure any trademark, service mark, logo, or trade name displayed on or in connection with CROSSNGOJOBS without our prior written consent.
10. User Conduct
- Protection of CROSSNGOJOBS:
- You agree not to attempt to gain unauthorized access to any accounts, systems, or networks connected to CROSSNGOJOBS or to disrupt or interfere with its operation.
- You may not use any automated means, including but not limited to bots, spiders, or scrapers, to access or interact with CROSSNGOJOBS without our prior written consent.
- Responsible Use of Communication Tools: You agree to use the messaging and communication features provided on CROSSNGOJOBS responsibly and professionally. You may not use communication tools to send unsolicited messages, spam, or other unauthorized communications to candidates.
- Reporting Violations: If you believe that another user is violating these Terms or engaging in harmful conduct, you agree to report such behavior to CROSS SECTOR HIRES LIMITED. We reserve the right to investigate and take appropriate action in response to reports of violations, including but not limited to suspending or terminating the accounts of users who violate these Terms.
11. Termination of Terms and Survival
Termination: These Terms shall automatically terminate upon the termination of and closing of your Employer account – whether by you or us. In the event of termination, your access to CROSSNGOJOBS and any associated services may be discontinued, and any data associated with your account may be deleted in accordance with our Privacy Policy. Your licenses and access to CROSSNGOJOBS also cease upon termination.
- Survival: Any provisions of these Terms that are intended to survive termination will survive termination, including but not limited to provisions related to intellectual property, disclaimer of warranties, limitation of liability, and indemnification.
12. Disclaimer of Warranties
- We strive to make your experience on CROSSNGOJOBS to meet your expectation. However, we cannot always guarantee that due to certain factors.
- To the maximum extent permitted by applicable law, CROSSNGOJOBS and all its content are provided to you “AS IS” and “AS AVAILABLE” without warranties of any kind – whether express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a specific purpose, title, or non-infringement.
- We cannot guarantee the quality, qualifications, or suitability of any job applicants who apply for positions through CROSSNGOJOBS. You are solely responsible for evaluating the qualifications of all applicants and making hiring decisions.
- We do not guarantee that your job postings will attract a certain number of qualified applicants or that you will fill any open positions.
- We make no warranties that (i) CROSSNGOJOBS or any content or information available through it is safe, reliable, accurate, or complete; (ii) CROSSNGOJOBS will operate uninterrupted, error-free, or secure; or (iii) CROSSNGOJOBS is free from bugs, worms, trojan horses, viruses, or other harmful software introduced by third parties.
13. Limitation of liability
- TO THE FULLEST EXTENT PERMITTED BY THE APPLICABLE LAW, IN NO CIRCUMSTANCES SHALL CROSS SECTOR HIRES LIMITED (OR ANY OF OUR LICENSORS, PARTNERS, AFFILIATES, AGENTS, EMPLOYEES, OR SUBSIDIARIES) BE LIABLE TO YOU OR ANY THIRD PARTY – WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE – FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES OR LOSS OF DATA, PROFIT, GOODWILL, REVENUE, OR OTHER INTANGIBLE DAMAGES THAT MAY OCCUR AS A RESULT OF YOUR USE OF CROSSNGOJOBS OR ANY OF ITS CONTENT – EVEN IF WE MAY HAVE BEEN HINTED OF THE POSSIBLE OCCURRENCE OF SUCH DAMAGES.
- NOTWITHSTANDING THE LIMITATIONS ABOVE, IN THE EVENT CROSS SECTOR HIRES LIMITED IS FOUND LIABLE FOR ANY LOSSES OR DAMAGES (NO MATTER THE COURSE OF ACTION), OUR TOTAL LIABILITY SHALL NOT EXCEED THE SUM OF #100,000 OR THE EQUIVALENCE IN ANY OTHER CURRENCY.
- THE LIMITATIONS ABOVE SHALL NOT APPLY TO LIABILITIES THAT MAY NOT BE EXCLUDABLE UNDER APPLICABLE LAWS.
14. Indemnity
You agree to defend, indemnify, and hold harmless CROSS SECTOR HIRES LIMITED (including our licensors, affiliates, partners, agents, employees, or subsidiaries) from and against any losses, liabilities, damages, demands, claims, and expenses (including reasonable attorneys’ fees) made by any third party due to your access and use of CROSSNGOJOBS or its content; your User Content; or your breach of these Terms, any applicable laws, or your representations and warranties.
15. Governing Law and Jurisdiction
- These Terms and any disputes arising out of or related to them or your use of CROSSNGOJOBS shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.
- Any legal action or proceeding arising out of or related to these Terms or CROSSNGOJOBS shall be brought exclusively in the courts located in the State of Lagos, Nigeria. You hereby consent to the exclusive jurisdiction and venue of such courts and waive any objection to such jurisdiction or venue on the grounds of inconvenient forum.
- Nothing in this section shall prevent us from seeking injunctive or other equitable relief in any jurisdiction where such relief is available to protect our rights or enforce these Terms.
16. Third-Party Links
Our website and other aspects of CROSSNGOJOBS may contain links to third-party websites or services that are not owned or controlled by CROSS SECTOR HIRES LIMITED. Such links are on CROSSNGOJOBS for reference purposes and do not guarantee our endorsement nor do we assume any responsibility for the content, privacy policies, or practices of any third-party websites or services.
You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any third-party websites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
17. Modifications
We reserve the right to modify, update, or amend these Terms at any time and for any reason, including changes in applicable laws or our services. Changes to these Terms may be communicated to you via your account email address, your dashboard, and/or a part of our website. Modifications to these Terms will go into effect immediately after we post them. Your continued use of CROSSNGOJOBS after any such modifications constitutes your acceptance of the modifications made.
18. General Terms
- Severability: If any provision of these Terms is found to be invalid or unenforceable under applicable law, such provision shall be modified or interpreted to accomplish the objectives of the provision to the greatest extent possible under applicable law, and the remaining provisions of these Terms shall continue in full force and effect.
- Entire Agreement: These Terms constitute the entire agreement between you and CROSS SECTOR HIRES LIMITED regarding your use of CROSSNGOJOBS and supersede all prior or contemporaneous agreements or understandings, whether oral or written, relating to the subject matter of these Terms.
- Assignment: You agree that we may assign our rights and obligations under these Terms to third parties. You agree that you, on the other hand, are not permitted to assign, transfer, license, or lease your rights – including your user account – to a third party without our written approval.
- Notices: Any notice you give to us under these Terms shall only apply when given via our email address at admin@crosssectorhires.com or our website contact form. Any notice we give to you shall be valid via your account dashboard or account-associated email address.
- Waiver: You agree that any rights that we do not enforce under these Terms at any point shall not limit our rights to enforce the same right at a later date or on similar violations. No waiver under these Terms shall be valid unless we give it in writing.
- Downtimes: You agree that CROSSNGOJOBS may not always run 24 hours every day – even though we will do everything commercially that it does. You agree that CROSSNGOJOBS may go offline for reasons, such as maintenances, system failures, and downtimes. However, in the event that CROSSNGOJOBS becomes unavailable due to the aforementioned reasons, we will not be liable for your inability to use it.
- Force Majeure: You further agree that we will not be liable for any loss or damages incurred from any delay or failure to provide CROSSNGOJOBS due to causes beyond our reasonable control, including, without limitation, wars, government actions, riots, server or internet breakdowns, or acts of God.
